U.S. Drops Defense of Law Banning Gay Marriage
By EVAN PEREZ
WASHINGTON—The Obama administration said Wednesday that it would not defend the constitutionality of a 1996 federal law that defines marriage as the union of a man and woman, after two years making the opposite argument.

The legal turnabout marks a contrast with the Justice Department's argument in recent years that it generally is obligated to defend federal laws, even when the administration opposes them. The administration made that assertion in defending the law that previously banned openly gay people from serving in the U.S. military. Congress has since repealed the "don't ask, don't tell" law.

See the letter that Attorney General Eric Holder sent to Speaker of the House John Boehner (R., Ohio) regarding the Defense of Marriage Act.
..President Barack Obama decided to stop defending the marriage law after considering "a number of factors, including a documented history of discrimination," the Justice Department said.

.Attorney General Eric Holder said the difference this time is that the latest challenges to the Defense of Marriage Act, also known as DOMA, were filed in November in New York and Connecticut.

The federal courts in those states are part of the Second Circuit, which has different legal precedents on gay issues from other court jurisdictions that have heard previous challenges to the marriage law, Mr. Holder said in a letter to House Speaker John Boehner.

Previous cases on the marriage law were "considered in jurisdictions in which binding circuit court precedents hold that laws singling out people based on sexual orientation, as DOMA does, are constitutional if there is a rational basis for their enactment," Mr. Holder said.

Michael Steel, a spokesman for Mr. Boehner, said: "While Americans want Washington to focus on creating jobs and cutting spending, the president will have to explain why he thinks now is the appropriate time to stir up a controversial issue that sharply divides the nation."

Mr. Obama opposes the Defense of Marriage Act, and Mr. Holder said the new cases prompted a reassessment of the administration's legal strategy.

Mr. Holder said members of Congress could choose to defend the law in court in light of the Justice Department's decision to drop its defense.

Los accionistas de AAPl rechazaron la propuesta que hubiera requerido que la compania ponga en efecto un plan para remplazar a S. Jobs.

Investors Reject Rule on Apple CEO Succession

By IAN SHERR And YUKARI IWATANI KANE
Apple Inc. shareholders defeated a measure that would have required the company to outline succession plans, according to preliminary tabulations at the company's annual shareholder meeting on Wednesday.

The succession-planning measure, brought by Laborers' International Union, would have required the Cupertino, Calif., electronics giant to produce an annual report on succession planning and develop criteria for candidates to the top position.

The call for more information about Apple's plans for changing leadership has taken on a new urgency since Chief Executive Steve Jobs, who received a liver transplant in 2009, went on medical leave suddenly last month. Neither the company nor Mr. Jobs have said what medical condition he is suffering from, nor indicated his prognosis.

Mr. Jobs didn't attend Wednesday's meeting, marking the second time in a decade he has missed the annual event.

A separate measure, brought by the California Public Employees' Retirement System, calling for a majority vote to elect unopposed candidates to the board appears to have passed.

Peter Oppenheimer, the company's chief financial officer, said the company wanted to retain its cash reserves – currently worth about $60 billion – to take advantage of any opportunities that might come along. Some investors have called on the company to issue a dividend or buy back shares with the money.

The shareholder meeting comes as Apple is expected to launch the next iteration of its iPad tablet. On Wednesday, Apple invited reporters to a March 2 event that will outline "what 2011 will be the year of." The invitation featured one of Apple's calendar app peeled back to reveal a device that resembled an iPad.

Apple launched the first iPad last April. Since then sales of the device have surpassed even Apple's own expectations, selling 14.8 million units as of the end of December. In the most recently reported fiscal quarter, Apple posted $4.6 billion in iPad revenue—about 17% of sales.

Gleacher & Co. expects Apple to sell 30 million more units this year.

The success of the next iPad device is key for Apple, which is facing increasing competition from the likes of Samsung Electronics Co., Motorola Inc. and Research in Motion Ltd, some of whom will coming out with advanced features such as high-speed data access.

People familiar with the situation told the Wall Street Journal last month that the next version of the iPad will be thinner, lighter and more powerful and will have at least one camera on the front of the device for features like video-conferencing.

Some of the people said the new iPad will initially be available through Verizon Wireless and AT&T Inc., but not Sprint Nextel Corp. or T-Mobile USA in the U.S.

Kuo Ming-Chi, an analyst for Concord Securities in Taiwan estimates that Apple's manufacturing partner in China will ship 4.5 million to 5 million units of the new iPad in the current quarter.

Technology news site All Things Digital on Tuesday reported that Apple would be holding the March 2 event. The website, like The Wall Street Journal, is owned by News Corp.
