Madoff's Son Is Found Dead in Apparent Suicide

NEW YORK—Bernard Madoff's elder son was found dead Saturday of an apparent suicide on the second anniversary of his father's arrest, according to law-enforcement officials.
Mark Madoff, 46 years old, was found hanged with a dog leash attached to a living-room-ceiling pipe in his apartment by his father-in-law, law-enforcement officials said. A relative notified police around 7:30 a.m. No suicide note was found, the officials said.
Mark Madoff's 2-year-old son was found unharmed in the apartment, along with a dog.
Law-enforcement officials said the father-in-law went to the apartment in Manhattan's SoHo section at the request of Mark Madoff's wife, Stephanie Morgan, who was in Florida, where she received an email from her husband indicating that she should have someone check on their son.
Mark Madoff's death comes as federal prosecutors have been scrutinizing Bernard's brother and sons, who haven't been charged with wrongdoing. Seven people besides Bernard Madoff, including his top lieutenant, Frank DiPascali, have been criminally charged.

.Bernard Madoff swindled a long list of investors out of billions of dollars and is serving a 150-year prison term in North Carolina. His sons went to authorities two years ago and said that he had confessed the Ponzi scheme to them.
Martin Flumenbaum, an attorney representing Mark Madoff and his brother, Andrew, on Saturday said: "Mark Madoff took his own life today. This is a terrible and unnecessary tragedy. Mark was an innocent victim of his father's monstrous crime who succumbed to two years of unrelenting pressure from false accusations and innuendo. We are all deeply saddened by this shocking turn of events."
It was unclear whether Bernard Madoff had been notified, but a person close to the situation said he most certainly would know because of the way news travels into the North Carolina prison. Bernard Madoff's lawyer, Ira "Ike" Sorkin, declined to say whether he had reached out to his client.
"This is a great tragedy at many levels," said Mr. Sorkin said. "He has expressed his remorse repeatedly and this can only add to his sorrow."
The scandal put a harsh light on members of the family. The financier's brother, Peter, played a prominent role in the family's company. Mark and Andrew Madoff both worked on a trading desk at the firm, on a side of the business that wasn't directly involved in the Ponzi scheme.
A year ago, the court-appointed trustee trying to unravel Bernard Madoff's financial affairs sued several members of the family, including the brothers, accusing them of failing to detect the fraud while living lavish lifestyles financed with the family's ill-gotten fortune. The lawsuit accused Mark Madoff of using $66 million he received improperly to buy luxury homes in New York City, Nantucket and Connecticut.

.This week, Irving Picard, the court-appointed trustee recovering assets for the victims, filed multiple lawsuits seeking funds from people and firms he alleged were close to the scheme or unwittingly profited at the expense of others. The sons' lawyer has called Mr. Picard's complaint baseless and has sought to have it dismissed.
On Saturday, Mr. Picard said, "This is a tragic development, and my sympathy goes out to Mark Madoff's family."
Ronnie Sue Ambrosino, who lost her and her husband's life savings in Mr. Madoff's scheme, said Mark Madoff must have been under "incredible pressure." She said she was sadden by the loss of his life, but also by the fact that his death represented the loss of another way to possibly learn the story behind the fraud.
"The worst part is it's another dead end," said Ms. Ambrosino, who has organized a group to speak out for Madoff victims. "We're just not finding out the truth."
In February, Mark Madoff's wife, Stephanie Morgan, petitioned a court to change her last name, saying her family had gotten threats and was humiliated by the scandal.
A person familiar with the family said both of Mr. Madoff's sons had been deeply depressed for some time, and had considered changing their names.
Mark Madoff had one child with his current wife, Ms. Morgan, and two children with his former wife, Susan Elkin of Connecticut, according to a civil lawsuit filed this week seeking to recover money from him and his relatives.
A spokeswoman for Preet Bharara, the U.S. attorney in Manhattan, declined to comment. Mr. Bharara's office is handling the continuing criminal investigation of the Madoff Ponzi scheme and had been scrutinizing Mark and Andrew Madoff and their uncle Peter.
The FBI declined to comment. A lawyer for Ruth Madoff, Mark Madoff's mother, said, "Ruth is heartbroken." Previously, spokespeople for the brothers had repeatedly denied that they had any knowledge of their father's crimes.
When reached at her home Saturday morning, Ms. Elkin, Mark Madoff's ex- wife, declined to discuss what happened.
New York City police Saturday guarded the doors of the building where Mark Madoff lived at 158 Mercer St. Police investigators were at the apartment Saturday morning, along with officials from the medical examiner's office, which will determine the cause of death. By late morning, news photographers, at least eight news trucks and a crowd or spectators were gathering at the scene.
Around 12:20 p.m., police quickly wheeled Mr. Madoff's body on a cart out of the building and into a medical examiner's van.
Friday morning, Mark Madoff dropped off an envelope and card for the parking attendants at Mercer Parking, where he parked his 2008 black Land Rover. He gave the attendants $400 and a greeting card decorated with penguins from him and his wife thanking them for their help, said an attendant there.
Anthony Diaz, 37, an attendant at the garage, said Mr. Madoff, his wife, child, babysitter, and dog often would leave early on Saturday mornings for trips to the family's summer home. "He's a nice guy," Mr. Diaz said. "I feel bad."
The Land Rover on Saturday was still parked in the garage, the attendant said.
